IMPORTANT INFORMATION

You should carefully read the following Terms and Conditions. Your purchase or use of all products implies that you have read and accepted these Terms and Conditions set here.

LICENSE

A purchase of a package via our website grants you non-exclusive rights to use the package on another website.

LIMITED USAGE

You may use each individual package on a single website only, belonging to either you or your client. You must make a further purchase in order to use the package on another website. Contact easymods.co.uk support for discount pricing information.

MODIFICATIONS

You are authorized to make any necessary modification(s) to our products to fit your purposes. You may not however redistribute or release any modifications as GPL or otherwise. You must also not change or remove any copyright, version, or production information from the package. Porting our products to other platforms and content management systems and redistributing as GPL or otherwise is also strictly prohibited. Please contact us if you have any requirements that are not covered by these terms.

UNAUTHORISED USE

You may not resell, or otherwise share, any of our packages, modified or unmodified, without prior written consent from easymods.co.uk. Any exceptions are made at the sole discretion of easymods.co.uk.

UPDATES

All bug fixes and minor updates to the same product are free to all valid customers. The client will be required to purchase any other updates which may become available. This includes major feature enhancement updates, and updates for major phpFoX version changes.

FILE DELIVERY

The payment process is not fully automated. After you purchase a product through PayPal, you will receive an email, with your order attached, to the email address you used with PayPal to make payment. This email should arrive within 24 hours of completed payment, if it does not you should contact easymods.co.uk support. If you choose to pay with an "e-Cheque", please note that the delivery is not instant. An "e-Cheque" will take 3-8 business days to clear. Once the payment has cleared, an email with your order attached will be despatched to your PayPal email address.

ASSIGNABILITY

You may not sub-license, assign, or transfer this license to anyone else without prior written consent from easymods.co.uk.

OWNERSHIP

You may not claim intellectual or exclusive ownership to any of our packages, modified or unmodified. All products are property of independent content providers. Our products are provided "as is". In no event shall our juridical person be liable for any damages arising out of the use of or inability to use our products.

RETURN/REFUND POLICY

Due to the open-sourced, irrevocable nature of our packages, no refunds are given under any circumstance other than under our System Guarantee detailed below. You acknowledge herewith that you will not cancel payment or seek post-purchase refund due to lack of having observed system requirements, a 'change of mind', any difficulty in operating the software due to lack of user knowledge, or any other condition not exacted by the System Guarantee below. You are responsible for understanding this upon purchasing. Please make sure that you've carefully read all relevant documentation and tried out the demonstrations of our products. Any refunds provided due to conditions not exacted by the System Guarantee below are made at our sole discretion.

SYSTEM GUARANTEE

If, following your full compliance with our support staff's recommendations and requests, one of our products fails to work as prescribed on your website, you will provided with a full refund.

SUPPORT

Whilst providing much support in many areas, easymods.co.uk only provides official support via email.

Technical support will not be provided for third-party modifications to any easymods.co.uk packages including modifications to code or design to any license holder. If any of the packages are modified using a third-party modification instruction or otherwise, technical support may be refused to any license holder.

WARRANTY

easymods.co.uk does not warranty or guarantee these products in any manner. We cannot guarantee they will function with all 3rd party extensions or templates as there is currently no certification process for such extensions or templates. All easymods.co.uk products are tested to work on all major browsers, including Mozilla Firefox, Microsoft Internet Explorer (and all Trident based browsers, version 6 and newer), Opera, Apple Safari (version 3 and newer).

CUSTOM/PROJECT DEVELOPMENT

Project Contents

All digital and non-digital materials supplied by the client to easymods.co.uk for project development must be, either owned by the client or given copyright permission for publication. easymods.co.uk is not responsible for copyright infringements found on/in these materials.

Cancellation of Project Development

A request to cancel a project must be made to easymods.co.uk via postal or electronic mail. easymods.co.uk will charge for the number of hours accumulated in project development before the cancellation request is made.

Pause in Project Development

A request to pause project development must be made to easymods.co.uk via postal or electronic mail. The delay will not exceed a period of 30 days. Unless other arrangements are made between both parties, easymods.co.uk will assume any delay requested by the client that exceeds the 30-day period a cancellation, and hence will charge for the number of hours accumulated in project development before the request to pause is made.

Payment Policy

Under the agreement of the Terms of Service, no payment is required until the client's balance reaches $350.00 or the project is completed - whichever occurs first. Any remaining balance will be due no more than 7 days upon receipt of the service invoice supplied by easymods.co.uk. easymods.co.uk has the right to charge a 5% late payment fee for every 7 days the balance is past due. easymods.co.uk reserves the right to suspend any and all current work being done due to failure of Client to remit payment. Balances that are 14 days past due are subject to removal from the servers including deletion of files. All services are non-refundable.

Ownership and Unauthorised Use

You may not resell any part of a custom developed project without prior written consent from easymods.co.uk. easymods.co.uk will inform you, in writing, if easymods.co.uk is not able to sell any part of a custom developed project to others. Until the client's full balance is paid, easymods.co.uk will retain sole rights to all parts of the project. Upon full payment, easymods.co.uk will grant a licence for the custom developed project to be used on one website. Any differentiations from this will be at the descretion of easymods.co.uk, and will be identify in writing for the client.

Please note that there is no guarantee that any email sent to easymods.co.uk will be received by easymods.co.uk, or that the contents of the email will remain confidential during internet transmission.

easymods.co.uk reserves the right to change or amend these Terms at any time and without prior notice. By acquiring service from easymods.co.uk, you signify your agreement to these Terms and Conditions.

You understand and agree that in easymods.co.uk's sole discretion, and without prior notice, easymods.co.uk may terminate your access to this website, cancel any ongoing projects you are involved with, terminate any existing product licences you hold, or exercise any other remedy available, if easymods.co.uk believes that you have violated, or your actions are inconsistent with these Terms and Conditions or the law. You agree that monetary damages may not provide a sufficient remedy to easymods.co.uk for violations of these terms and conditions and you consent to injunctive or other equitable relief for such violations. easymods.co.uk may release user information about you if required by law or subpoena, or if the information is necessary or appropriate to release to address an unlawful or harmful activity. easymods.co.uk is not required to provide any refund to you if you have violated these Terms and Conditions.
